Hiring Rights

Do you think you were asked questions during your hiring interview process that were not legal? Did they delve into your personal health history or ask discriminating questions? You have the right not to be asked these questions during the interview process, but that doesn’t stop many supervisors from asking them. If you are asked, politely decline to answer. You should decline to answer any questions that reveal your marital status, sexual orientation, age, religious beliefs, if you have children or want children, national origin, or disabilities.

Discrimination:

You have the right not to be discriminated against at work for your age, sex, race, national origin, disability, or religion.

Payment and Equal Pay

First, you have the right to be paid for the work you’ve done. You also may have the right to overtime pay if you work beyond the regular company hours. Second, you have the right to equal pay for equal work.

Safety Rights

You have the right to a safe work environment. Employers have obligations to create safe work environments for their employees.

Harassment

You have the right not to be harassed at work. This could mean that you have the right not to have to listen to crude language or lewd jokes or look at crass images even if they’re not directed at you.

Retaliation

You have the right not to be retaliated against for complaining or filing a complaint about discrimination or harassment in the work environment. It is illegal for an employer to retaliate, meaning that you may have protections if an employer fires or demotes an employee for complaining of harassment or discrimination.
