How do you deal with Human Resources (HR) at big companies when they dismiss your sexual harassment complaints?

 

Microsoft’s HR is in the news for allegedly dismissing dozens women’s sexual harassment complaints without investigations. Microsoft is reportedly currently investigating these overlooked complaints.

 

Other companies in the news recently for sexual harassment claims include Google, CBS, USC, and more.

 

What is the role of HR?

 

A company’s Human Resources department has multiple functions and sometimes they may conflict with one another. HR is typically in charge of workplace safety, employee relations, labor law compliance, and training and development. On the one hand, HR functions primarily to protect employees by following labor laws, but on the other hand, they’re also tasked with protecting the company. These two positions can come in conflict with one another when an internal issue such as a sexual harassment complain arises.

 

Does this make HR ineffective?

 

Although HR should prioritize protecting employees and following laws and regulations that address the matters, this isn’t always the case. Many times HR will opt to protect the company’s image and reputation instead.

 

How can employees overcome these barriers?

 

Employees who have suffered sexual harassment or discrimination in the workplace and who have filed complaints with HR but have not had their case investigated have a few options.

 

  • They can and should speak to an employment attorney who can assist with filing a lawsuit. An employee should keep files, evidence, and witness contact number to provide their attorney.

 

  • The employee may be able to file a complaint with the EEOC.

 

  • Finally, the employee may be able to speak out publicly and draw attention to the issue. Perhaps it’s more widespread of an issue in the company than previously thought. The #metoo movement has opened many doors for women and men to come forward with their stories.
