New York sexual harassment protections were implemented for workers in August, 2018. The state now requires employers to establish sexual harassment policies.
A copy of the policy must be provided to all employees.
New York State has added new pages devoted to the new sexual harassment protections policy.
A draft version of a sexual harassment policy was provided on the New York State website. Employers, however, could create their own by following the minimum guidelines set forth by the state.
Employers must be compliant with the new sexual harassment laws by October 9, 2018. Additionally, employers must also provide sexual harassment training to all their employees. All employees must take this sexual harassment training on or prior to January 1st, 2019.
The new sexual harassment protections also have been expanded to cover non-employees such as volunteers, interns and contractors. Furthermore, the policy widens the definition of what is considered sexual harassment to include “harassment on the basis of… sexual orientation, gender identity, and the status of being transgender.”
Before the deadlines hit, employers will want to update their sexual harassment policies to ensure that they are compliant, as well as offer training to all their employees, including new employees who may have already had the training at their previous job.
