Now that President Trump has rescinded transgender protections, what are the rights of transgender people in New York?

Despite the work of the Trump Administration to dismantle transgender rights, transgender students are still protected under Title IX, the Constitution, and New York state laws. Here are a few of the protections and rights of transgender people in New York.

According to the New York Civil Liberties Union, under these protections New York students right the right to:

“Use the restroom and locker room in accordance with their gender identity.

“Participate in gender-segregated activities in accordance with their gender identity.

“Adhere to dress codes in accordance with their gender identity and expression.

“Be protected from harassment based on their gender identity and expression.

“Maintain privacy regarding their gender identity.”

Title IX is a federal anti-discrimination law that protects transgender students in America and President Trump can’t stop or undo those legal protections. To find out if you have more protections, take a look at your state laws.

These protections could be strengthened. The New York government should try to improve upon these protections by closing loopholes in the laws that make certain protections confusing or weak.

If you’ve been discriminated against for your gender identity there are steps you can take. Contact an attorney near you for more information about your particular case.
